FAQ-1. In regard to Section 5.7.1 of the RFP Rules, can you please clarify what the “scheduled day of awarding bids” refers to?
The “scheduled day of awarding bids” referenced in Section 5.7.1 of the RFP Rules refers to the day the Pennsylvania Public Utility Commission (“PaPUC”) is expected to make its decision on the RFP results.
FAQ-2. Does the submission of the Bid Assurance Collateral and Default Service SMA obligate a bidder to submit bids on the Bid Proposal Due Date?
A Qualified Bidder must submit Bid Assurance Collateral and Default Service SMA in order to bid. However, if a Qualified Bidder does not submit a bid after it has submitted Bid Assurance Collateral and Default Service SMA materials, this is permissible.
FAQ-3. At what time will bidders be notified if they have winning bids?
Bidders will be notified by the close of business (6PM EPT) on the Bid Proposal Due Date if they have winning bids.
FAQ-4. Paragraph 1.1.4 of the RFP Rules states: “[…]For the purposes of this RFP, the Default Service Load will be reduce by any net excess generation purchased from net metering (customer generation) as well as supply the Company is obligated to purchase pursuant to the Public Utility Regulatory Policies Act (“PURPA”).” What are PPL’s purchase obligations pursuant to PURPA?
Currently, PPL Electric is not obligated to purchase any load pursuant to PURPA. The composition of load procured outside of full requirements default service contracts by PPL Electric includes net metering customer supply, block energy contracts and NYPA load, where appropriate. However, there is always a possibility the Company may be required to purchase load per PURPA, which is why it is specifically identified in the RFP Rules.
FAQ-5. Would the discussion between two Sellers regarding Assignment of one Seller’s Default Service SMA load obligation to another violate any of the certifications or representation contained in the RFP Rules?
Any discussion between two Sellers may violate terms of the RFP Rules, such as the Binding Bid Agreement. You should consult your attorney on this issue.
FAQ-6. Can you provide me details regarding the specific products offered in each solicitation as well as the percent of the Default Service Load that will be served by each product? Are there any graphics regarding the products offered in each solicitation available on the RFP Web site?
For the specific products offered in each solicitation as well as the percent of load that will be served by each product, please refer to section 1.1.13 of the Default Service RFP Rules. A graphical layout that shows which products are being offered at each solicitation is provided in the Bidder Information Presentation.
FAQ-7. Our entire team is going to be out of the country the week that bids are due. Is there any way to submit a sealed bid by the end of the week prior to the Bid Proposal Due Date?
All Bid Proposal Spreadsheet(s) must be submitted by secure electronic file transfer to the PPL secure server during the window to submit bids on the Bid Proposal Due Date. Please note that the electronic file transfer system is web-based and can be accessed from any location as long as you have an internet connection.
FAQ-8. If our company wish to make a price offer for 4 Total Tranches Supplied, are we required to enter price offers for all smaller numbers of Total Tranches Supplied (1, 2 and 3) that are lower price offers than that for 4 Total Tranches?
If you wish to enter a price offer for 4 Total Tranches Supplied, you must also enter bids for 1, 2, and 3 Total Tranches Supplied.
However, there are no restrictions on the dollar amounts of the prices that you enter into the cells of the Bid Proposal Spreadsheet. If you bid on 4 Total Tranches Supplied, your bids for one, two or three tranches could be more or less than your bid for 4 tranches. Please keep in mind that there are strict rules governing the cells that must be filled out in order for your Bid Proposal Spreadsheet to be accepted.
FAQ-9. We understand that Addendum 6 to the RFP allows for a “download password” to be entered in the space provided for the signature. Given it is no longer a requirement for the Binding Bid Withdrawal Agreement (Exhibit 10) to be signed, please confirm that we can simply email a word version of the completed form to remove one or more Bid Proposal Spreadsheet(s) and that you do not require the file to be in a pdf format.
Your understanding is correct. A word version of the completed form is acceptable.
FAQ-10. Are we required to include the DocuSign signature certificate if we use DocuSign to complete the digital signatures?
At this time, use of (i) a manually signed signature or (ii) a digital signature via DocuSign or Adobe Sign is deemed automatically approved by PPL Electric. The DocuSign signature certificate is not required.
